Terms & Conditions

These terms govern services provided by Spark Stream Media, with its office at Bhive Premium HSR Sector 6, L-148, 5th Main Rd, HSR Layout, Bengaluru, Karnataka 560102.

Definitions

‘Services’ means digital marketing, content creation, consultancy or other services supplied by Spark Stream Media. ‘Client’ means the person or business purchasing those Services. A Business Day excludes weekends and Bengaluru public holidays.

Applicability and contract

These terms apply to contracts with the Client unless otherwise agreed in writing. A contract begins when Spark Stream Media accepts an order in writing or starts performing the Services.

Our obligations

We will deliver Services with reasonable skill and care and in material conformity with the agreed specification. Timelines may be affected by force majeure or Client-related delays. We may use subcontractors while remaining responsible for delivery.

Client obligations

The Client must provide accurate information, timely assistance and approvals; notify us of relevant technical changes; and confirm it has the rights to all supplied materials. Delays or omissions may affect delivery and invoicing.

Pricing and payment

Prices are in Indian Rupees and exclude GST unless stated otherwise. Quotes may change for scope changes or errors. Invoices are due within 14 Business Days; deposits and additional charges may apply where agreed.

Liability

Except in cases of wilful misconduct or negligence, liability is limited to fees paid for the affected Services. We are not liable for indirect losses and do not guarantee rankings, traffic volumes or sales outcomes.

Intellectual property

The Client grants us permission to use supplied materials to deliver the Services. Intellectual property developed by Spark Stream Media remains ours unless agreed otherwise in writing. We may use the Client’s name and logo for promotional purposes as set out in the contract.

Confidentiality and termination

Both parties must protect confidential information. A contract may be terminated for material breach, insolvency or non-payment, and may otherwise renew or end according to the agreed order terms.

Force majeure and governing law

Neither party is liable for failures caused by events beyond reasonable control. These terms are governed by Indian law and disputes are subject to the courts of Bengaluru, Karnataka.
